II. ROLES AND FUNCTIONS:

 

1. The Inspectorate of Dong Nai Department of Science and Technology (DOST) is a division under DOST and helps the Director of DOST to carry out the function of the State management in science and technology and legal affairs; conduct administrative and specialized inspections; deal with complaints and denunciations; and prevent corruptions within the State management of DOST according to legal provisions.

 

2. The Inspectorate is under the directions and management of the Director of DOST, offers guidance on organizational work and professional skills of the provincial Inspectorate, and under the directions and professional skill instructions on the science and technology inspections of the Inspectorate. 

 

3. The Inspectorate of DOST has its own seal.

 

III. RESPONSIBILITY AND AUTHORITY:

 

The Inspectorate of DOST is in charge of the tasks and authorities stipulated in the Government’s Decree no. 213/2013/ND-CP dated December 20, 2013 on the organization and operation of the Inspectorate of Science and Technology; the Government’s Decree no. 27/2017/ND-CP dated March 15, 2017 on amending and adding a number of articles of the Government’s Decree no. 213/2013/ND-CP dated December 20, 2013 on the organization and operation of the Inspectorate of Science and Technology; the Government’s Decree no. 55/2011/ND-CP dated July 4, 2011 on defining the functions, tasks, authority and organizational machinery of legal organizations and the specific tasks as follows:

 

1. Inspection:

 

a) Develop and submit inspection plans to the Director of DOST for approval; carry out inspection plans within the responsibility of the Inspectorate of DOST; guide, urge, monitor and inspect the performance of inspection plans of the Department of Standards, Metrology and Quality; gather and deal with the overlapped tasks within the authority of inspection and examination or submit them to the Director of DOST for a decision within the State management and according to legal provisions.

 

b) Offer guidance on professional inspections to the inspectors and civil servants in charge of the inspection at DOST.

 

c) Examine the accuracy and legality of inspection conclusions and post-inspection settlement decisions of the Director of Department of Standards, Metrology and Quality for the cases involving DOST’s State management related sectors and areas if necessary.

 

d) Conduct administrative inspections towards the implementation of policies, laws and tasks of agencies, organizations and individuals under DOST’s direct management.

 

d) Conduct specialized inspections of the observance of laws on science and technology for the organizations and individuals under DOST’s management.

 

f) Give administrative sanctions over violations according to the legal provisions on how to deal with administrative violations.

 

g) Monitor, urge and inspect the implementation of the conclusions, recommendations and settlement decisions on inspection of the Director of DOST and the Inspectorate of DOST.

 

h) Assist the Director of DOST to meet with people, deal with complaints and denunciations according to the law on complaints and denunciations.

 

i) Perform anti-corruption tasks in accordance with the law on anti-corruption.

 

k) Offer guidance and conduct inspections at the agencies and units at DOST according to the legal provisions on inspection.

 

l) Request the Director of Department of Standards, Metrology and Quality to report on inspection; and collect and report on the inspection results within DOST’s management.

 

m) Mobilize officials and civil servants of the relevant agencies and units to participate in the inspection team according to legal provisions.

 

n) Inspect the other tasks assigned by the Director of DOST.

 

2. Legal affairs

 

a) Legal construction

 

- Host and coordinate with concerned units to assist the Director of DOST to make a proposal to formulate legislative documents of the provincial People’s Council and People’s Committee related to the field of State management of science and technology.

 

- Host and coordinate with concerned units to assist the Director of DOST to coordinate with the Department of Justice to draft an annual program of formulating legal documents of the provincial People’s Council and People’s Committee related to the field of State management of science and technology.

 

- Host and coordinate with concerned units to prepare and submit draft legal documents related to the field of science and technology to the Director of DOST to ask agencies, organizations and individuals to join hands in making recommendations or suggestions to the Department of Justice for appraisal and submission to the provincial People’s Committee for promulgation.

 

- Host or join hands in drafting legal documents, regulations, processes, and procedures related to science and technology in accordance with the assignment of the Director of DOST.

 

- Give opinions on the format and contents of the draft legal documents drafted by divisions and units of DOST before submitting them to the Director of DOST for consideration and decisions and then to the Department of Justice for appraisal.

 

- Host or coordinate with concerned units to assist the Director of DOST to leave comments on the draft legal documents by the Ministry of Science and Technology, the provincial People’s Committee, and the People’s Committees of districts, communes, departments and sectors to call for contributive opinions.

 

b) Reviewing and systematizing legal documents

 

- Host, summarize and report to the Director of DOST on DOST’s reviewing and systematizing legal documents in the field of State management; make recommendations and proposals on settling measures according to regulations in the process of reviewing and systemizing legal documents to the Director of DOST.

 

- Host and coordinate with concerned units to review the administrative documents issued by DOST and other departments and sectors; legal and administrative documents issued by the People’s Committees of districts, Long Khanh town and Bien Hoa city to implement the legal documents on science and technology.

 

- Host and coordinate with concerned units at DOST, ask the Director of DOST to deal with the administrative documents issued by DOST and other departments and sectors; legal and administrative documents issued by the People’s Committees of districts, Long Khanh town and Bien Hoa city contrary to legal documents.

 

- Make reports to the Director of DOST and then submit them to the Director of Justice for reviewing and submitting to the provincial People’s Committee the results on how legal documents are reviewed and settlement solutions are put forward to deal with contradictory, overlapping, illegal or inappropriate legal documents every six months or every year.

 

c) Inspecting and dealing with legal documents

 

- Host and assist the Director of DOST to coordinate with the Department of Justice to inspect and handle legal documents in accordance with the law.

 

- Make reports on the inspection and settlement of legal documents and submit them to the Director of DOST and then to the Department of Justice for reviewing and reporting to the provincial People’s Committee.

 

d) Disseminating the education on science and technology law

 

- Host and coordinate with concerned units to make plans and disseminate legal education for a long term or every year and submit them to the Director of DOST and carry out plans after approval

 

- Collaborate with the Legal Affairs Department at the Ministry of Science and Technology in offering refresher courses on legal skills and knowledge of science and technology to the officials and civil servants of the units at DOST.

 

- Build a legal database on the portal of DOST and manage and exploit it effectively.

 

- Host and coordinate with advisory units to assist the Director of DOST to conduct inspections and review the dissemination of law and education; report to the Department of Justice on the dissemination of laws and education so that the Department of Justice can summarize and report it to the provincial People’s Committee and the Ministry of Justice.

 

d) Monitoring law enforcement and inspect legal observance

 

- Host and coordinate with concerned units to assist the Director of DOST to monitor, urge and inspect the execution of the law in the field of science and technology in Dong Nai province.

 

- Host and make reports on how to monitor law enforcement and check the observance of law in the field of science and technology and then submit them to the Director of DOST and then to the Department of Justice.

 

- Proactively suggest attending the activities of the divisions, committees and units at DOST related to the law enforcement.

 

e) Administrative procedures control

 

- Host and assist the Director of DOST to coordinate with the Department of Justice to control administrative procedures in accordance with the law.

 

- Prepare a report on the development and implementation of administrative procedures control, and submit it to the Director of DOST and then to the Department of Justice for reviewing and reporting it to the provincial People’s Committee.

 

- Coordinate to apply the one-stop-shop mechanism to deal with administrative procedures.

 

g) Giving advice on legal issues and participating in legal proceedings

 

- Give legal opinions on how to deal with the issues in the field of science and technology; provide legal comments on important decisions, guidelines and directive documents of the Director of DOST.

 

- Host or coordinate with concerned units to offer the Director of DOST advice on legal issues during the legal proceedings to protect legitimate benefits according to the law.

 

- Host and coordinate with concerned units to join hands in handling, recommending and proposing measures to prevent and remedy the consequences of the violations of laws, rules and regulations as assigned by the Director of DOST.

 

h) The State’s compensation

 

- Host and coordinate with concerned units to assist the Director of DOST to carry out the State’s compensation in accordance with the law.

 

i) Legal assistance for businesses

 

- Host and assist the Director of DOST to coordinate with the Department of Justice to provide legal assistance for businesses in accordance with the law.

 

- Host or coordinate with concerned units to reply to the legal questions of businesses, organizations and individuals on science and technology in accordance with law.

 

3. Other tasks

 

- Manage the civil servants, assets, documents of the Inspectorate of DOST according to responsibilities and legal provisions.

 

- Perform other tasks assigned by the Director of DOST according to the law.
